busytask AI Terms of Service

1. Who we are

busytask AI is run by busytask LLC, a Maryland limited liability company, in Baltimore, Maryland. In these terms, "busytask", "we" and "us" mean that company. You can reach us at [email protected], or by phone or text at 667-214-2286 (Monday to Friday, 9 AM to 5 PM Eastern).

These terms are for busytask AI: the website we build and host for your business, the AI employees, and your account at ai.busytask.com. They are separate from the terms for busytask's Marketing plans (busytask.com/legal) and for busytask Pro (busytask.com/crm-terms/). If you also buy those, their own terms apply to them.

2. Who these terms are for

"You" means the business that signs up and the person who signs up for it. That person confirms they are allowed to accept these terms for the business. busytask AI is for businesses, not for personal or household use. You must be at least 18 years old to sign up.

By paying for a plan or using busytask AI, you agree to these terms and to our Privacy Policy at busytask.com/privacy.

3. What busytask AI is

busytask AI gives a small business:

  • A website, designed and built by our team, hosted by us, on your own web address (section 7);
  • AI employees that work in a chat in your browser: Wendy (Website Manager), Sam (SEO Expert), Ben (Blog Writer), Mia (Social Media Assistant), Ivy (Image Designer), Rosa (Review Responder), Owen (Office Assistant) and Max (Sales Assistant). Penny (Phone Receptionist) is an optional add on, sold separately at the price shown when you add her. What each one does is described on our website and in the app. We may add, change or remove employees and features (section 12);
  • An account page, for your business details, your website's messages, your connections and your billing.

busytask AI is a tool. It does not give legal, tax, accounting or financial advice. You decide how you run your business, what you charge and what you publish.

4. Drafts only: you approve everything public

Our AI employees prepare work for you. They don't act for you without your OK:

  • A change to your website, a blog post, a reply to a Google review, a post to your Facebook Page or a change to your Google Calendar happens only after you approve that exact change in the chat or on your account page.
  • Email replies are saved as drafts in your Gmail. busytask never sends an email for you: you open the draft and send it yourself.
  • busytask never contacts your customers or the businesses Max finds for you. Quotes, letters, messages and scripts are for you to send or use.
  • You are responsible for what you approve and publish.

The AI can make mistakes. It is an AI tool. It can misunderstand you, get facts wrong or write something that doesn't fit your business. Check every draft, image, quote and answer before you rely on it or approve it.

5. Price, billing and refunds

Price. busytask AI costs $75 a month, plus a one-time setup fee of $26, in US dollars. On the day you sign up you pay $101: the setup fee and your first month. After that, $75 is charged every month on the same day, to the card on file, until you cancel. Our prices don't include sales tax. We don't charge sales tax today. If the law requires us to, we'll add it to your invoice and say so.

Paying. Plans are paid by card through Stripe, our payment provider. We never see or store full card numbers. On your account page, "Manage billing" opens Stripe's page, where you can update your card, see invoices or cancel.

What's included each month. Every plan includes a monthly amount of AI use ("AI credits"), up to 30 new images a month and up to 8 new blog posts a month. Editing a post you already have doesn't count as a new one. Your account page shows how much of the month's AI credits is left. When they run out, your AI team stops answering until your next monthly payment, when they are reset. Unused credits, images and posts don't carry over. Using up your monthly allowance never adds a charge.

Failed payments. If a monthly payment fails, your AI team is paused until the payment goes through, and we email you a link to your account page to update your card. Stripe retries the payment by itself. Your website stays online while it does. If the payment still hasn't gone through after about 2 weeks, your plan ends (section 13).

Price changes. We may change our prices. A new price never changes what you pay without notice: we email you first, and the new price starts at your first monthly payment at least 30 days after that email. If you don't want the new price, you can cancel before then.

Refunds. The $26 setup fee and monthly payments are not refundable, including for a month you cancel partway through or a month in which you didn't use busytask AI. The only exception: if we charged you twice by mistake for the same thing, we refund the duplicate charge in full.

6. Your website

Building it. After you sign up, our team builds your website, usually within 1 to 2 business days. We send you a private link to see it. It goes live only after your OK.

Content from your current website. To build your new site, we may copy text and photos from your current website. By signing up, you confirm that you own, or have permission to use, that content and anything else you give us (your logo, photos, videos and text), and you are responsible for it. If you ask us to remove any photo or text, we remove it.

Who owns what. Your own text, photos and logo stay yours. You give us permission to use them, only to build, run and show your website and to let your AI employees work for you. The website's design and code, and everything we or our AI employees make for it apart from your own content, belong to busytask. While your plan is active, you may use the website for your business.

Keeping it up. We host your website and keep it running, but we can't promise it will always be available or free of errors (section 12).

7. Domains (your web address)

Your website goes live on your own web address, like www.yourbusiness.com.

  • A domain you already own stays yours. You connect it, or we help you connect it. We never need the password to your domain company account.
  • A domain we register for you: free for the first year, then $18 a year, charged to your card. We confirm the exact spelling with you before we register it. Domains busytask registers are registered to busytask. You can ask to have a domain transferred to you, for a $150 transfer fee. Write to [email protected].
  • When your plan ends, we stop billing for a domain we registered for you after the year already paid for. If you haven't asked for a transfer by then, we may let the domain expire.

8. Connecting your accounts

You may connect your Google Business Profile (for Rosa's review replies), your Google Calendar and your Gmail (for Owen), and your Facebook Page (for Mia's posts). You connect each one on the other company's own page, and you can disconnect it at any time on your account page. We use what we get from these connections only to do what you ask, as the Privacy Policy describes. Those services are run by Google, Meta and our providers under their own terms. If they change or stop what busytask AI relies on, a feature may change or stop.

9. Your information

The information you give us and what your AI team makes for you are handled as our Privacy Policy describes. We don't sell it and don't use it for advertising. Don't put information we don't need into the chat, such as card numbers, bank account numbers, Social Security numbers, health information or passwords.

10. Acceptable use

You agree not to use busytask AI to:

  • break any law, including laws about advertising, email, privacy, consumer protection and copyright;
  • publish anything false, misleading, hateful, harassing or illegal, or anything you don't have the right to use;
  • send spam, or contact people in ways the law doesn't allow;
  • pretend to be someone else, or trick people into giving payment details, passwords or other information;
  • post fake reviews, or reviews or replies that pretend to be from someone else;
  • try to get into another business's account or data, or test, scan or attack the service's security, or get around its limits;
  • copy, resell or overload the service, or use it to build a competing product.

We may remove content from your website that breaks these rules. If you find a security problem, please tell us at [email protected] and don't use it.

11. Support

Email [email protected], or call or text 667-214-2286, Monday to Friday, 9 AM to 5 PM Eastern (closed weekends). A person usually replies within 1 business day. If we need to see your screen to help, we will send you to busytask.com/remote-help. Only open a remote session when you are already talking with a busytask team member.

12. Our service and changes

We work to keep busytask AI running, safe and backed up, but we can't promise it will always be available or free of errors. Maintenance and things outside our control (hosting, Cloudflare, Stripe, Google, Meta, AI providers, internet outages) can affect it. We improve busytask AI all the time and may add, change or remove features or AI employees. If we remove something important that you rely on, we will tell you ahead of time when we reasonably can.

We don't promise results: no particular ranking on Google, number of visitors, leads, reviews or sales.

13. Cancelling and ending

By you. There is no contract. You can cancel at any time on your account page ("Manage billing"). Your plan runs to the end of the month you've already paid for, then ends. No refund is given for the rest of that month (section 5).

When your plan ends (you canceled, a payment wasn't made, or we ended it):

  • your AI team stops, and your Google Business Profile, Google Calendar and Gmail connections are removed;
  • your website goes offline. We keep it for 2 months, then delete it. If you sign up again within those 2 months, we can put it back. We don't give a copy of the website (its design and code belong to busytask, section 6);
  • your own text, photos and logo stay yours. Ask us within those 2 months if you want copies of the photos and logo you gave us;
  • domains: see section 7.

By us. We may suspend or end your plan at once if you seriously or repeatedly break these terms, or if your use puts the service, other customers or other people at risk. We may also end these terms for any reason with 30 days' notice by email. No refund is given when we end them (section 5). If we ever stop offering busytask AI, we will tell you at least 60 days before.

14. No warranty

busytask AI is provided "as is" and "as available". To the extent the law allows, we make no promises beyond those in these terms, and we disclaim all implied warranties, including that it is fit for a particular purpose or free of errors. This includes everything the AI employees write, make or suggest.

15. Limit of liability

To the extent the law allows, we are not liable for lost profits, revenue, business or data, or for any indirect, special or consequential damages, even if we were told they could happen. Our total liability for all claims about busytask AI is no more than the fees you paid us for busytask AI in the 1 month before the event that caused the claim. These limits don't apply where the law doesn't allow them.

16. Indemnity

You will defend and cover busytask against claims, losses and costs (including reasonable lawyers' fees) brought by others because of the content you give us or approve for publishing, your dealings with your customers, or you breaking these terms or the law.

17. Law and disputes

These terms are governed by the laws of the State of Maryland, without regard to its conflict of law rules. Any dispute will be heard only in the state courts in Baltimore County, Maryland, or in the United States District Court for the District of Maryland. Before going to court, please email us at [email protected] and give us 30 days to try to sort it out.

18. Changes to these terms

We can change these terms at any time. The new version takes effect when we post it at busytask.com/ai-terms/ with its date. For important changes, we'll also email you at least 7 days before they apply. If you don't agree, you can cancel.

19. General

These terms and the Privacy Policy are the whole agreement between you and us about busytask AI. If part of these terms can't be enforced, the rest still applies. If we don't enforce a part right away, we can still enforce it later. You can't transfer these terms to someone else without our written agreement. Neither side is responsible for delays caused by things outside its reasonable control. We send notices to the email you sign in with. You send notices to [email protected].
